Unlawful entry, also known as breaking and entering, is usually the term used in law enforcement in regards to the criminal act of entering a building, home, or facility of any kind with the intention of committing some sort of illegal act. Typically, the illegal act associated with breaking and entering will usually involve burglary or theft. Furthermore, breaking and entering is also further defined by taking each term and providing a definition.
In UNLAWFUL ENTRY, Ray Liotta plays an obsessed, out-of-control cop, Pete Davis, who terrorizes a young married couple (Kurt Russell and Madeleine Stowe). Davis does everything in his power to separate the couple so he can have the wife all to himself. Everything builds to a predictable, bloody climax. UNLAWFUL ENTRY is a poorly produced film filled with graphic sex, obscene language and senseless violence.
Unlike burglary, which generally requires entry into a building or structure with intent to commit a crime, unlawful entry onto property/trespass involves mere presence on property without authorization or consent. As such, it is a far less serious offense.
Breaking will involve the forcing of any impeding structure, such as a door or fence, for the purpose of entering a building structure illegally. However, this also does not necessarily mean that a physical destruction be necessary to qualify. Entering is the actual physical entry of a person or some sort of instrument or item without permission from the owner of the property. However, depending on jurisdictions and laws, there will be differences in the definition of unlawful entry and breaking and entering.
I believe the supreme court has upheld that law enforcement who are knowingly breaking the law are considered a threat to life and in turn pose a real threat to citizens.
It is still 100% illegal for the officer to enter a home without permission or a warrant or reasonable cause. The 4th Amendment doesn’t grant us the right to resist arrest. It is to protect us against unreasonable search and seizure. The right is still there. The officer will not get away with it, they just don’t want people to resist while it’s happening, reducing the likeliness of violence.
However a burglar breaks in to the structure, they must also enter the structure in order to satisfy this element. The entry can be minimal; the burglar doesnt have to actually walk into a building in order to commit a burglary. Sticking a hand through a window counts as an entry sufficient to support a charge of burglary.

To be guilty of criminal trespass, a person need not actually break a window or door to enter the structure. Simply entering a structure that an individual does not have permission to be in is sufficient to establish a criminal trespass. It should be noted that if the individual does enter a structure with the intent to commit an offense therein, they might be charged with the more serious crime of burglary.
Even with a valid reason, the landlord has to give you 24 hours notice before entering your rental. If the landlord shows up without warning, you can let her in if you choose, but you don’t have to. Exceptions to this rule include if it’s an emergency or if you agree in advance to let her in. Your landlord or her agent may deliver the notice in person, leave it with a roommate, stick it under the door or mail it to you.
Apartments, condominiums and homes are all at risk of burglary and intrusion. Landlords, maintenance workers and pest control technicians have pass keys to your home. Unexpectedly, you may find yourself with a stranger in your home. Locks are not always re-keyed from the prior tenants. Your security and privacy may be at risk.
